CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: 9/14/09
Present: Richard Andrus, David Dempsey, Judith Bach and Christopher Blair. Tim Lovett arrived later in the meeting.
The meeting convened at 6:15p.m.
Ahye 656 Main Rd (R. Andrus is the project manager)
Shannon Boomsma of White Engineering and representative for the Ahye’s was present to discuss the modifications being made to the original submission which includes: in ground swimming pool, additions to pervious patio, a pervious path to pool, a hot tub, a retaining wall, a gravel or mulch walking path, an extended retaining wall to create a back yard, landscaping and planting. The Commission asked for some more information on the Hemlocks to be planted and for additional trees to be planted than what was noted.
Wasserman 40 Elephant Rock Rd – request to amend the WPA OOC DEP#230-021 (D. Dempsey is the project manager)
Shannon Boomsma of White Engineering and representative for the Wasserman’s was present to explain the request to include the removal of 2 small trees and some limbs within 100 feet of Lake Garfield. The Commission is going to make a site visit before approving the amendment; this hearing will be continued to the October meeting.
Dodyk – 22A Elephant Rock Rd – Req. for Certificate of Compliance DEP#230-191 (T. Lovett is the project manager)
Shannon Boomsma of White Engineering and representative for the Dodyk’s was present to request that a Certificate of Compliance be issued. The Board issued the certification.

Hartman – 37 Steven’s Lake Rd – RDA - to excavate within an existing building footprint, temporarily stockpile excavated and borrowed material, and perform minor site improvements within the 50’ no disturbance zone and the 100’ buffer zone of Steven’s Pond. A portion of the proposed work will occur within the buffer zone of a stream that bisects the property (Rick Andrus is the project manager)
A representative from Greylock Design was present to discuss the project with the Commission. The Commission approved it as an N3.
Miller – 24 Carrington-Battelle Rd
The Millers were sent an Enforcement Order after (according to the owner after a site visit was made by a Con Comm member in response to a complaint) wood ties retaining the upper pond were in danger of collapse, an effort is being made by the owner's contractor to build the chute out of stone. No effort was or is being made in regards to sedimentation and runoff issues, there appear to be wetlands immediately downstream of the ponds that are most likely being affected by runoff as well as the stream bed. The Commission was requiring that sedimentation efforts need to be put in place (cover stockpiled soils and sedimentation controls) and they should get the work completed and soils stabilized as quickly as possible, then follow up with a a wetlands delineation by a certified Wetlands Engineer/Specialist at the
Conservation Commission September meeting.
The Millers were unable to attend the meeting but did respond in writing to the Commission and included pictures of the work that had been done. In response to the Enforcement Order the Millers have retained Berkshire Wetland Services to conduct a wetland delineation. This will be continued to the October meeting. The Commission agreed that the contractor that performed the violation should also be bought in to speak with the Commission.
Dolber – 142 Main Rd
An Enforcement Order was sent in August at the recommendation of DEP as the following items had not yet been completed from a previously issued a Determination of Applicability: 1. The new tree that was to be planted has not been. 2. The (4) five foot pieces of rebar that were to be placed at the edge of the mowed area and buffer zone boundary to indicate that no cutting should occur south of that line have not been installed. The rebar is to protrude one foot out of the ground and must be capped with a wetlands boundary cap. Two of the pins should be placed on the east and west lines of the mowed area with the remaining two pins spaced equally in between totaling four pins. and 3. The location of the pins has not been recorded in the Registry of Deeds to date with a proof of
recording being forwarded to the Monterey Town Hall/Monterey Conservation Commission.
The above listed activities were agreed to be done when the Dolber's were issued a Determination of Applicability. All communications sent to the Dolber's inquiring about the completion of these items have been ignored.
For Discussion:
1. Mail was reviewed.
2. Minutes from 8.10.09 were approved as written.
3. Chris Blair attended a site visit at 64 Main Rd on 8/27/09 along with DEP and the Director of Operations after a complaint was made to DEP by the homeowner claiming that the Town may have done something stormwater related that impacted his property. The Town had added some drop inlets across the street to prevent road erosion and then under the road to one of the fields. There is a natural flow south easterly into Stevens Lake. As far as everyone present could see there didn't appear to be jurisdictional wetlands along the way, so it is a dispute between the landowner and the Town.
